Justice Gregory Carro granted suppression hearings and allowed the remaining counts, including second-degree murder, multiple weapons charges, and possession of a forged instrument, to proceed.<\/p>\n\n\n\n<p>Justice Carro found that Counts 1 and 2, charging first-degree murder \u201cin furtherance of an act of terrorism\u201d and second-degree murder as a crime of terrorism, were legally insufficient. <\/p>\n\n\n\n<p>Carro concluded that employees of a single company do not constitute a \u201ccivilian population\u201d under New York\u2019s terrorism statute and that the evidence did not show Mangione acted with the statutory intent to intimidate or coerce a civilian population or influence government policy.<\/p>\n\n\n\n<p>A spokesperson for Manhattan District Attorney Alvin Bragg told <a href=\"https:\/\/edition.cnn.com\/2025\/09\/16\/us\/luigi-mangione-ny-court-hearing\">CNN<\/a> the office respected the court\u2019s decision \u201cand will proceed on the remaining nine counts,\u201d including second-degree murder.<\/p>\n\n\n\n<p>Prosecutors had presented evidence that surveillance video captured the shooter near the Hilton hotel in midtown Manhattan; that a water bottle, cellphone, and backpack discarded after the attack carried the defendant\u2019s DNA; and that ballistics matched a handgun later recovered from Mangione\u2019s backpack at the time of his arrest in Altoona, Pennsylvania. <\/p>\n\n\n\n<p>Justice Carro wrote that while the killing was \u201cheinous\u201d and \u201ctargeted,\u201d it did not resemble the kind of large-scale or indiscriminate attacks that New York\u2019s terrorism law was meant to cover.<\/p>\n\n\n\n<p>In the parallel federal case, the U.S. Justice Department will seek the <a href=\"https:\/\/bnonews.com\/index.php\/2025\/04\/luigi-mangione-to-face-death-penalty-in-murder-of-unitedhealthcare-ceo\/?swcfpc=1\">death penalty<\/a> against Mangione, Acting U.S. Attorney Matthew Podolsky was directed to pursue, according to Attorney General Pamela Bondi\u2019s April announcement. <\/p>\n\n\n\n<p>Federal prosecutors allege the killing was premeditated and carried out in public view.
